RESIDENTS of Bayan Villa town houses in Taman Bukit Serdang, Seri Kembangan, were a happy community when they bought the hilltop property that was surrounded by greenery.
However, after moving in 2014, they faced various problems such as leaking roofs and cracked walls.
Another issue has cropped up.
They are not happy with their developer’s plan to allow outsiders to trespass their compound to enter a public clubhouse located adjacent to it.
The clubhouse by developer Bukit Ikhlas Development Sdn Bhd is attached to the Bayan Villa homes and its main entrance faces the compound of the gated-and-guarded townhouses.
It has yet to be opened to the public.
Residents are complaining that there was no mention of a clubhouse as a common facility in their sales and purchase agreement.
Resident and Joint Management Body (JMB) committee member Sofiyant Neo said that even if the management was to station security guards at the clubhouse, there is no guarantee they would be able to prevent clubhouse guests from loitering in the Bayan Villa compound.
“When we bought our houses, we were told that the road facing the clubhouse would be the entrance to Bayan Villa. As there is an ongoing development on that road, our entrance is the only way in now,” he said.
Sofiyant said his roof had been leaking since he moved in years ago and that the JMB had spent about RM500,000 to maintain the lifts. Twenty of the total 64 lifts were not functioning.
There are 430 units in Bayan Villa.
JMB chairman Phoon Chee Keong said the six-year-old Bayan Villa, a four-storey townhouse project, was a good place to live in.
“It is peaceful, there is a lot of greenery and it is cooling here because we are up on a hill,” he said.
“The JMB plans to take up the matter with the Urban Well-being, Housing and Local Government Ministry,” he said.
Bayan Villa residents have not received their strata titles and have no inkling as to when it would be given.
A Bukit Ikhlas Development Sdn Bhd spokesman said the strata title was still in progress.
“It will take time as we had made amendments to the overall development plan.
“We submitted the proposed amendments sometime between 2011 and 2012 for block titles from the Land Office and are still waiting for approval.
“We will start applying for the strata title,” said the spokesman, adding that the clubhouse was not part of Bayan Villa and a decision on the entry way had yet to be finalised.
