REHDA Institute’s Strata Planning & Management event was successfully held on 12th September 2019 at The Club @ Bukit Utama, attracting more than 300 attendees from as far as Penang, Kedah, Johor, Negeri Sembilan, and Melaka
Dato' Jeffrey Ng, Chairman of REHDA Institute, was present to give the keynote opening address in the morning. Notable speakers from relevant stakeholders such as the government authority, developer, architect, and lawyers, were present to share their knowledge and expertise on strata management which are still pertinent areas in which many property developers and related stakeholders have been seeking clarification.
Azlan bin Salim, Assistant General Manager, Head of Design and Product Development of UMLand started off by sharing his experiences on Project Planning in Commercial, Residential, and Mixed Developments.
He mentioned that when developers consider developing a place for future residents to live, they should consider adding certain key elements such as access and linkages, while addressing comfort and image, functionality, activities, and sociability into their development.
Tuan Shahril Bin Omar, Director, Commissioner of Buildings (COB) for the Kajang Municipal Council mentioned that the roles and responsibilities of the Commissioner of Buildings in each local authority can be considered as a tough and heavy role – therefore, cooperation by all relevant parties is very important in order for the COB to deliver the best service to the people.
Ar. Dr Tan Loke Mun, the founding director of ArchiCentre Sdn. Bhd, DTLM Design Group, and the principal of Dr. TanLM Architect then followed up with his presentation on the Certificate of Completion and Compliance (CCC), the Partial CCC, Extension of Time (EoT).
He proposed that the Housing Development Act be amended to allow Partial CCC to be accepted for the delivery of Vacant Possession which will facilitate the delivery of Vacant Possessions to the purchasers for the early phases.
A panel discussion was moderated by Datuk Charlie Chia Lui Meng, Group Director of UM Land, joined by Ar. Dr. Tan Loke Mun and Tuan Shahril Bin Omar as the panellists, who answered various questions from the floor.
In the afternoon session, Chris Tan, the founder and managing partner of Chur Associates highlighted that in the event that Vacant Possession (VP) is delivered with strata title, the developer shall be responsible to properly maintain and manage the subdivided building or land and common property during such preliminary management periods, according to s.48 (1) of SMA 2013.
Mary Lau, a business owner and contributor for StarProperty, gave an interesting presentation on the different rates of charges during the JMB period in a mixed development project.
She mentioned that if different rates are used, she proposed that the COB should review and determine rates that are approved at AGMs if owners are not satisfied, or to have at least one representative from each component to sit in the JMC.
The last speaker of the day had Dato’ Pretam Singh of Advocates and Solicitors Pretam Singh, Nor & Co. shared his views on the Strata Management Tribunal. Dato’ Pretam stressed that the Tribunal should have the jurisdiction to hear and determine any claims specified in Part 1 of the Fourth Schedule, where the total amount in respect of which an award by the Tribunal is sought does not exceed RM250,000.
The final panel discussion of the day featured Ngian Siew Siong (editor of the Strata Management Handbook), Mary Lau, Dato’ Pretam Singh, and Low Hon Keong (Executive Director, Henry Butcher Malaysia (Mont Kiara) Sdn. Bhd.). It was an engaging session as there were many interesting questions raised during the session.
